GENERAL PROVISIONS
The material that appears on LeaseTrader is for informational purposes only.
Despite our efforts to provide useful and accurate information, errors may appear from time to time. Before conducting any transaction, including but not limited to, the leasing or transferring an automobile lease, that you've read about on LeaseTrader, you should confirm with the leasing company any information (including, where the lease of a vehicle is concerned, the monthly auto lease payments, inception fees, taxes, lease term, lease end buyout, excess mileage charge, total allowed mileage, and actual mileage of the vehicle) that is important to your decision. LeaseTrader is not responsible for, and does not guarantee the performance of, any such goods or services or information.

The Lease Transfer process requires each party (buyer and seller) to provide information essential to the transaction. Such information may include an individual or company's name, address, phone number, e-mail address, Vehicle's description details, and other information ("User Information"). The LeaseTrader's Web Site accepts the User Information supplied by various Users, and LeaseTrader assumes no responsibility for testing or verifying the accuracy of such User Information, and does not endorse or approve of any Leased Asset, or any Current Lessee or Prospective New Lessee. The User Information is used by LeaseTrader, the seller and buyer to contact each other, and the legal owner of the leased asset ("Lessor") to screen, approve or deny, and facilitate the Lease Transfer process.

LeaseTrader's services are available to individuals and business. Individuals agreeing to be bound by this Visitor Agreement on behalf of a business must be an officer or agent of such business who is authorized to form legally binding contracts on behalf of the enterprise under applicable law. And any such person hereby certifies that is an officer or agent of such business. LeaseTrader may also refuse to provide the Services to anyone or any entity at any time, in our sole discretion and LeaseTrader reserves the right to deny use of this service to anyone who uses the service in manner we consider inappropriate.

LeaseTrader respects the privacy of its users. Please take a moment to review our Privacy Policy.

You may not use the Message Center for advertising or promotional materials or other forms of solicitation not related to the applicable Listing Number.
Given the nature of the Service and the volume of messages and listings, LeaseTrader cannot monitor all messages transmitted though the Message Center. However, please contact a LeaseTrader customer service representative if you encounter any communication that is obscene, defamatory, or otherwise unacceptable. LeaseTrader reserves the right to delete, move, or edit any communication that it deems in its sole discretion to be a violation of this Agreement or defamatory or insulting in any way.

VEHICLE LISTINGS
LeaseTrader DOES NOT REVIEW every vehicle listing posted on LeaseTrader.com. You may well read any given listing before anyone on the LeaseTrader staff does. You can expect these areas to include information and opinions from a variety of individuals and organizations other than LeaseTrader. We do not endorse or guarantee the accuracy of any listing. Responsibility for what is listed in LeaseTrader lies with each user. You alone are responsible for material you post. By using LeaseTrader.com you agree not to post or transmit any defamatory, abusive, obscene, threatening, misleading, or illegal material, or any other material that infringes on the rights of others or interferes with the ability of others to enjoy LeaseTrader. We retain the right to deny access to anyone who we believe has violated these terms or any other term of this agreement.
Although LeaseTrader cannot monitor all the listings in the LeaseTrader.com site, we reserve the right (but assume no obligation) to delete, move, or edit any postings that come to our attention that we consider unacceptable or inappropriate, whether for legal or other reasons. We will not, in the ordinary course of business, review the content of private electronic messages that are not addressed to LeaseTrader.com. However, we will comply with the requirements of the law regarding disclosure of such messages to others, including law enforcement agencies.
You will not use the service to violate the copyright, trademark, or other intellectual property rights of any person or other entity. By submitting material to LeaseTrader, you are representing that you are the owner of the material, or are making your submission with the explicit consent of the owner.

OWNERSHIP OF LISTINGS AND COPYRIGHTS
You hereby grant LeaseTrader a non-exclusive license to publish all listings you provide us. LeaseTrader is not responsible for any damage or loss to any listings, copy, drawings, and art or any other materials you provide. You herby agree that by placing a listing on LeaseTrader, you hereby grant a license to LeaseTrader a non-exclusive basis, all copyrights and other ownership rights in the listing, including the right to publish, reproduce, display, adapt, transmit, or produce derivative works in any medium, including any digital electronic medium.

Registration (FREE)
To obtain access to certain LeaseTrader.com services, you will be given an opportunity to register with LeaseTrader. As part of the registration process, you will be required to enter a valid e-mail address and a password. You agree that the information you supply during that registration process will be accurate and complete and that you will not (i) register under the name of, nor attempt to enter the service under the name of, another person; nor will you (ii) adopt a user name that LeaseTrader, in its sole discretion, deems offensive. You will be responsible for preserving the confidentiality of your password and will notify LeaseTrader's Customer Service Manager of any known or suspected unauthorized use of your account.

BUYER PROGRAMS
Buyer Program Selection
LeaseTrader is pleased to make available to you, three distinct buyer programs. Please note that the fees for these programs are Non-Refundable.

Credit Application Fee
The required credit verification service is processed for your convenience by Credit Verification Services and are Non-Refundable.
The sellers on this site want to deal with Credit Qualified buyers ONLY.
Therefore, in order to communicate DIRECTLY with one or more sellers you must be Credit Qualified through our Credit Verification Service. Please note that there is a NON-REFUNDABLE fee for this service.

Applicant Transaction Fees
LeaseTrader charges the buyer a $249.95 one-time Non-Refundable transfer initiation fee once there is initiation or a commencement of the lease transfer process, taking over a leased vehicle or to purchase a vehicle listed or that was listed on the LeaseTrader.com web site.

Instant Transfer Rebate - $100.00
LeaseTrader offers the buyer a $100.00 (One Hundred Dollar) Instant Transfer Rebate to be applied automatically once the payment is made at the initiation* of the transfer process. Failure to notify and pay the transfer initiation fee at the initiation* of the transfer process will result in forfeiting any and all discounts and rebates offered by LeaseTrader.

It is the buyer’s responsibility to notify and pay LeaseTrader’s transfer dept. the moment there is an initiation* of a transfer. Failure to notify and pay the transfer initiation fee, will result in penalties. A $100.00 charge will be assessed for each buyer that goes through the process of having their credit verified in order to contact the seller, plus all expenses incurred by LeaseTrader resulted from and not limited to credit verification, and the continued marketing of the vehicle.

Please Note: Each leasing company charges a fee to process the transfer generally paid by the buyer.

* The definition of an initiation of a lease transfer process is when any of the following occur: the seller requests to start the transfer process, the buyer requests to start the transfer process, the seller and buyer both agree on moving forward with the transfer process, the seller supplies the buyer with the leasing company's credit application, the leasing company provides de buyer with the credit application, the buyer completes and submits the credit application to the leasing company or whichever occurs first.

Buyers Peace of Mind Program Fees
LeaseTrader offers, vehicle condition inspection services, Vehicle History Report, Transportation Quotes and other services to enhance your leasing experience. Please note that these fees are Non-Refundable.

SELLER PROGRAMS
Vehicle Listing Fee
-All Advertising Listing Fees are non-refundable and vary by the type of listing.
-You will see the current listing rates when you post your lease.
-In order to get the contact information of Credit-Qualified Buyers that indicate an interest in taking-over your lease, a Gold Listing is Required.
Any request for cancellation will take effect within 3 business days and should be directed via e-mail.
All processed and billed listing fees are Non-Refundable.

Vehicle Listing Upgrade Fees
Choose several optional features to help promote and enhance your listing. Please note that these fees are non-refundable and some of them are for a limited time.

Seller Transaction Fees
LeaseTrader charges the seller a one-time $249.95 Non-Refundable (transfer initiation fee) once there is an Initiation* of the lease transfer process (transfer of equity, lease assumption, adding a buyer to your lease contract, the selling of your car, the transfer of your leased vehicle, when a buyer takes over the sellers car) with an interested party provided directly or indirectly by LeaseTrader.com.

Instant Transfer Rebate - $100.00
LeaseTrader offers the seller a $100.00 (One Hundred Dollar) Instant Transfer Rebate to be applied automatically once the payment is made at the initiation* of the transfer process. Failure to notify and pay the transfer initiation fee at the initiation* of the transfer process will result in forfeiting any and all discounts and rebates offered by LeaseTrader.

It is the seller’s responsibility to notify and pay LeaseTrader’s transfer dept. the moment there is an initiation of a transfer*. Failure to notify and pay the transfer initiation fee, will result in penalties. A penalty of $100.00 will be assessed for each buyer that goes through the process of having their credit verified in order to contact the seller (you), plus all expenses incurred by LeaseTrader resulted from and not limited to credit verification, and the continued marketing of your vehicle.
Please Note:
Each leasing company charges a fee to process the transfer generally paid by the buyer.

SPECIALTY SERVICES AND PROGRAMS:
Full Assumption Program Fee
Customized Lease Program offered to our sellers based on special circumstances imposed by their leasing companies unwilling to allow them to exit their lease contract. This service is provided on a agreed upon fee structure established by LeaseTrader and the lease holder, fees may vary based on service and program. Fees are Non-Refundable.

RATES
LeaseTrader reserves the right to revise rates, terms and specifications contained in the current listing rates.

PAYMENTS
Credit Card
-We accept all major credit cards, including Visa®, MasterCard®, American Express®. Please be sure to provide the exact billing address and telephone number that your credit card issuer has on file for you. Incorrect information may cause a delay in the processing.

Disputed credit card transactions possibly will be assessed the credit cards processor's processing charge for each time the transaction is disputed, plus administrative expenses plus any collection and/or attorney fees and court costs associated with any deviation of our fee structure and collection of debt.

REFUND POLICY

ALL FEES BILLED AND COLLECTED BY LEASETRADER ARE NON-REFUNDABLE.

Listing, Advertising and Promoting Fees
All processed and billed listing, advertising and promoting fees are Non-Refundable.

Buyer Program Fee
All Processed and billed Buyer Programs are Non-Refundable.

Credit Application Fee
These fees are processed for your convenience by Credit Verification Services and are Non-Refundable.

Lease Transfer Service Fee
One time Non-Refundable Fee.

Full Assumption Program Fee
Non-Refundable Fee.

RESPONSIBILITY OF LEASETRADER
LeaseTrader shall display the listings submitted by you in LeaseTrader.com (the Site) subject to your listing remaining in good standing. Your listings will be placed in the Site's listing database, which may be accessed by visitors to the Site. LeaseTrader reserves the right to reject and/or remove any listing submitted by you for any reason.

Special positions for your listing(s) are not guaranteed. However, some special positions may be available for a premium. In our effort to provide you with committed and suitable take-over candidates, we may require candidates to undergo a pre-screening process. Please note that these are LeaseTrader's SOLE responsibilities.

Posting a lease does not guarantee in any way that your lease will be successfully transferred or that you will not be require fulfilling your obligations with the leasing company listed as the Lessor on your lease contract.

It is also important to note that our pre-screening process does not guarantee that the take-over candidate will obtain the approval of the finance company to take over or assume your lease. For additional fees, LeaseTrader may, from time to time, offer services to expedite and enhance you lease transfer experience.

IMPORTANT LEASE INFORMATION
All lease transfers, terminations, and assumptions require the approval of the Financial Institution listed as the "Lessor" in your lease contract. Some financial institutions charge fees in connection with transferring a lease. These fees are separate from any fees paid by you to LeaseTrader and are solely YOUR responsibility.
Refund Policies. LeaseTrader shall only issue you a listing fee refund in cases where the Lessor listed in your lease contract has a non-lease transfer policy. Any applicable refund shall be limited to the initial listing fee(s) paid to LeaseTrader. Unless specified elsewhere in this agreement to the contrary, all other fees collected by LeaseTrader, including but not limited to, credit application fees, are non-refundable.

IMPORTANT OBLIGATIONS
You guarantee that any listing you submit is truthful and in compliance with all copyright laws and all other applicable laws and regulations. You guarantee that you shall conduct yourself ethically in the use of the Site and in any transaction resulting from said use.

Disclaimer of Warranties and Limitation of Liability
IF YOU RELY ON THIS SERVICE OR ANY MATERIAL AVAILABLE THROUGH THIS SERVICE, YOU DO SO AT YOUR OWN RISK.
YOU UNDERSTAND THAT THERE MAY BE DELAYS, OMISSIONS, INTERRUPTIONS, INACCURACIES, AND/OR OTHER PROBLEMS WITH THE INFORMATION, PRODUCTS, AND SERVICES PUBLISHED OVER THIS SITE.
THIS SERVICE IS PROVIDED TO YOU "AS IS." LEASETRADER AND ITS AFFILIATES, AGENTS AND LICENSORS CANNOT AND DO NOT WARRANT THE ACCURACY, COMPLETENESS, CURRENTNESS, NONINFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE INFORMATION AVAILABLE THROUGH THE SERVICE (OR ANY INFORMATION, GOODS OR SERVICES THAT ARE REFERRED TO, ADVERTISED ON, OR SOLD THROUGH THIS SERVICE). NOR DO THEY GUARANTEE THAT THE SERVICE WILL BE ERROR FREE, OR CONTINUOUSLY AVAILABLE, OR THAT THE SERVICE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT LEASETRADER AND ITS AFFILIATES, AGENTS AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.
YOU AGREE THAT THE LIABILITY OF LEASETRADER AND ITS AFFILIATES, AGENTS AND LICENSORS, IF ANY, ARISING OUT OF ANY KIND OF LEGAL CLAIM IN ANY WAY ARISING OUT OF OR OTHERWISE RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, TO THE SERVICE FOR USE OF THE SERVICE. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

MISCELLANEOUS
No spamming. You agree not to gather any e-mail addresses through LeaseTrader.com for purposes of spamming. By submitting material to LeaseTrader you are permanently granting LeaseTrader all rights to the material, including the right to modify the material, to use it commercially, and to maintain the material in an archive. This Agreement has been made in, and shall be construed in accordance with the laws of, the State of Florida. By using this service, you consent to the exclusive jurisdiction and venue of the state and federal courts in Miami-Dade County, Florida in all disputes arising out of or relating to this Agreement.
